Certain employees that are terminated for non-misconduct related reasons may be entitled to obtain unemployment compensation benefits. One way to claim these benefits is by going through an online application process with the State’s Agency for Reemployment Assistance website (floridajobs.org). After the Agency has processed the application, a Letter of Determination will be issued that states whether benefits will be paid or not. Both the employer and employee have the right to appeal the decision made by the Agency. Although there is no requirement to have an attorney throughout the process, there are a number of legal issues and requirements that govern both the application and appeal process, including strict deadlines that must be met.
