Do I need to support my spouse after the Divorce?
In many cases, one spouse may be entitled to receive financial support from his/her ex-spouse. The award of alimony or spousal support depends upon a variety of factors that are enumerated in Florida law. Federal tax laws have recently changed so that alimony awarded after December 31, 2018 is not deductible by the payor spouse or taxable to the recipient spouse. Since typically the payor spouse’s marginal tax rate is higher than the recipient spouse’s tax rate, where possible, alimony awards should be finalized prior to the end of this year. In this changing legal environment, it is important to be represented by an attorney familiar with these changes who can best help you secure the support you need, or, if you are the payor spouse, can minimize the burden of spousal support payments.
