The Florida Constitution and Florida Statutes require that decisions of public bodies be made in public meetings, with few exceptions. However, public officials often devise schemes and ways to circumvent this required transparency, usually for political purposes. For example, a critical land use decision affecting the city may be discussed privately, resulting in clandestine decision-making. Our lawyers have invalidated major government decisions that were the product of such illegal and secret deliberations and decision-making. This law is often a powerful tool in the arsenal of a land use litigation strategy since the law declares void any official act taken in violation of the requirements of the Government in the Sunshine Act, commonly known as the Sunshine Law.
